Ad watchdog refers Genspark to the FTC over unproven claims

Your move: Genspark did not respond to the inquiry, which is what triggered the referral

On September 9, 2026, the National Advertising Division (NAD), part of BBB National Programs, said it is referring Genspark to the Federal Trade Commission and other regulators. As part of its routine ad-monitoring work, NAD had asked Genspark to back up claims it made about its AI agents on its website and in New York City subway ads. Despite repeated attempts to reach the company, Genspark never gave a substantive response, and NAD says that failure to engage is what triggers a referral for possible enforcement action.

Why it matters

A referral doesn't mean the FTC will act, but it puts Genspark's marketing claims about what its agents can actually do under regulatory scrutiny, and the company chose not to defend them when first asked. If you're evaluating Genspark for your team, weigh its marketing claims with extra caution until this is resolved.
